We consolidate the interlocutory appeals taken in State v. Gathman-Matotan and Urioste v. Warden of the Penitentiary of New Mexico. In each case, the various state parties alleged a cause of action for breach of implied warranty of sufficiency of plans and specifications against Gathman-Matotan Architects and Planners, Inc.
