Plaintiff appeals a judgment of the district court dismissing his complaint, seeking relief under 42 U.S.C. §§ 1983 (1970) and 1985(3) (1970), for failure to state a claim upon which relief may be granted. Fed.R.Civ.P. 12(b)(6). We are of the opinion that plaintiff states a claim actionable under 1983 against certain defendants, but agree with the district court's dismissal...
