The instant appeal follows defendant's second trial and conviction for the crimes of grand larceny in the second degree and burglary in the second degree, he having been originally tried and convicted in December of 1977. By order entered January 21, 1980, this court reversed the earlier conviction and remitted the matter for a new trial (People v Tamulewicz, 73 A.D.2d 984).
