On October 25, 1977, defendant was convicted following a jury trial of the crime of criminal possession of a weapon in the second degree (Penal Law, § 265.03), a class C felony. He was, therefore, sentenced as a predicate felon to an indeterminate term of imprisonment of 7½ to 15 years, and his conviction was affirmed by this court without opinion on May 31, 1979 (70 A.D.2d 789).
