Order reversed, on the law, without costs or disbursements, and motion granted to the extent of declaring that section 1277 of the Public Authorities Law requires the payment by Nassau County to the Metropolitan Transportation Authority of its bill for station maintenance costs regardless of whether the county disagrees with the amount claimed by the authority to be due and owing.

The order of Special Term found that no justiciable controversy existed at the time...
