RICE v. FIERN

No. 82-506.

108 Wis.2d 454 (1982)

322 N.W.2d 481

Gordon A. RICE and Walter L. Harvey, Plaintiffs-Appellants, v. Robert H. FIERN, Defendant-Respondent.

Court of Appeals of Wisconsin.

Decided May 5, 1982.

Attorney(s) appearing for the Case

For the defendant-respondent the cause was submitted on the brief of Robert J. Kay and Geisler & Kay, S.C. of Madison.

No brief was filed on behalf of plaintiffs-appellants.

Before Gartzke, P.J., Bablitch and Dykman, JJ.

PER CURIAM.

The trial court denied plaintiffs' motion to join an additional defendant under sec. 803.05, Stats. Plaintiffs appeal from that order. We conclude that the appeal must be dismissed because it is from a nonfinal order not appealable as of right under sec. 808.03 (1), Stats.
