PUTZ v. SCHULTE

No. 80-519.

104 Ill. App.3d 128 (1982)

432 N.E.2d 1070

FRANK PUTZ, Plaintiff-Appellant, v. WARREN J. SCHULTE et al., d/b/a McCandless-Schulte Development Company, Defendants-Appellees.

Appellate Court of Illinois — Fifth District.

Opinion filed February 11, 1982.

Attorney(s) appearing for the Case

Gomric, Kurowski & Donovan, of Belleville (John J. Kurowski, of counsel), for appellant.

James W. McRoberts, Jr., of McRoberts, Sheppard, McRoberts & Wimmer, P.C., of East St. Louis, for appellees.

Orders reversed.

JUSTICE JONES delivered the opinion of the court:

The sole issue presented in this appeal is whether the trial court had jurisdiction to enter a post-judgment order expunging from its judgment a provision that defendants were to refund to plaintiff a deposit of $3000 made upon a real estate purchase agreement. We are asked to re-examine the holding of this court in Stotlar v. Stotlar (1977), 50 Ill.App.3d 790
