PER CURIAM.

This is an appeal from a conviction of first degree kidnaping which was entered following a jury trial and a verdict of guilty. We reverse and remand.

The facts are virtually undisputed and indicate that appellant Wilcott was driving by a school in Rathdrum, Idaho, and picked up a fourteen year old hitchhiker who was seeking a ride to his home located approximately a mile and a half away.
