WAKULLA COUNTY, ETC. v. FLACK

No. AI-496.

419 So.2d 1124 (1982)

WAKULLA COUNTY ABSENTEE VOTER INTERVENORS & J. Michael Carter, Appellants/Cross Appellees, v. Evelyn R. FLACK, Appellee/Cross Appellant.

District Court of Appeal of Florida, First District.

Rehearing Denied October 4, 1982.

Attorney(s) appearing for the Case

Wilson W. Wright, Tallahassee, for appellant/cross-appellee, Wakulla County Absentee Voter Intervenors.

J. Michael Carter, appellant/cross-appellee, pro se.

Rivers Buford, Jr., and Keith J. Kinderman, Tallahassee, for appellee/cross-appellant, Evelyn R. Flack.

WENTWORTH, Judge.

This appeal is from a final judgment ordering that the absentee ballots cast in the 1978 election for Wakulla County Judge not be counted, and that the appellee Flack should be certified and commissioned in that office. Upon consideration of briefs and oral argument by the parties and intervenors, we conclude that the result reached by the trial court complies with the mandate in Flack v. Carter, 392 So.2d 37
