This case is before the court on automatic appeal. (Pen. Code, § 1239, subd. (b).)1 Appellant was convicted of the murder, kidnap and robbery of Theresa Greybeal. (§§ 187, 207, 211.) The jury also found to be true two special circumstances, that the murder was willful, deliberate, and premeditated and was committed during the commission or attempted commission of (1) robbery...
