The court now considers defendant's first motion for summary judgment. Defendant's first motion asks that the court dismiss or strike the individual plaintiffs' claims for damages based on nuisance, negligence, and willful and wanton misconduct resulting from alleged injuries suffered prior to the date which is one year before their respective suits were filed.
