This is an appeal from a conviction of murder in the first degree for which the jury recommended and the trial judge imposed a sentence of death. We have jurisdiction. Art. V, § 3(b)(1), Fla. Const. While this case was pending before this Court, motion was made and granted for this Court temporarily to relinquish jurisdiction to the trial court in order for appellant to file a Florida Rule of Criminal Procedure 3.850 motion to vacate judgment...
