Silton Turner, plaintiff, has sued his employer, J & J Wells Construction Company, and its insurer, Tri-State Insurance Company, for workmen's compensation benefits. It is undisputed that Turner was struck on the right side of his head by a falling tree limb in the course of his employment as a logger on June 19, 1979.
