NOLAN, J.

In 1975 the petitioner was convicted of assault with intent to murder, G.L.c. 265, § 15; assault and battery by means of a dangerous weapon, G.L.c. 265, § 15A; and unlawful possession of a machine gun, G.L.c. 269, § 10(c). He appealed under G.L.c. 278, §§ 33A-33G. We took the defendant's appeal for direct review and affirmed his convictions. Commonwealth v. Cepulonis, 374 Mass. 487
