TYSON, Judge.

Edward Smith was indicted for "rape" for violating § 13A-6-61, Code of Alabama 1975. The jury found him "guilty as charged" and the trial court sentenced him, pursuant to the Alabama Habitual Felony Offender Act, to life imprisonment without parole.

Sufficient evidence was presented by the prosecution to support the jury's finding that this appellant raped the prosecutrix on January 24, 1981, either...
