Defendant was convicted, at a bench trial, of third-degree criminal sexual conduct, MCL 750.520d(1)(a); MSA 28.788(4)(1)(a). He was sentenced to a prison term of from 5 to 15 years and appeals by right.

Less than a year before the trial in the instant case, defendant was tried and convicted by the same judge of assault with intent to commit criminal sexual conduct involving penetration, MCL 750.520g(1); MSA 28.788(7)(1), and was sentenced...
