This action was initiated by Cargill, Inc. against Wayne and Darlene Perlich for the replevin of hogs under a security agreement and the collection of unpaid sums due on promissory notes. Upon the filing of the complaint, Cargill also filed an affidavit for immediate possession of the hogs. At the hearing1 on Cargill's request, Shipshewana State Bank appeared and moved to intervene, claiming a superior interest...
