Defendant was charged with criminal sexual conduct in the third degree, MCL 750.520d; MSA 28.788(4). Prior to trial, the trial court heard arguments on the prosecution's request to admit evidence of a prior similar act. The court heard the testimony of one Ms. Beard concerning the alleged prior similar act of rape by defendant and granted the motion. Defendant waived his right to a jury trial.
