Appellants, Joseph A. Orlando and Anna L. Orlando, brought suit against appellees, Tony Alamo, Susan Alamo and The Tony and Susan Alamo Foundation (Alamo Foundation). Jurisdiction was based on diversity of citizenship, 28 U.S.C. § 1332. Appellees filed a motion to dismiss, contending that (1) the complaint failed to state a claim for which relief could be granted and (2) appellants' claims were barred by the statute of limitations.
