Plaintiff, who cut and hauled pulpwood for his employer, Files Timber Company, Inc., suffered an on-the-job injury to his back in March, 1979. Plaintiff reported his injury to his employer and a claim for workmen's compensation benefits was filed with the employer's insurer, defendant Worldsurance, Inc.
