Lawrence James was charged in Count I with unlawful distribution of heroin and in Count II with unlawful possession of heroin with intent to distribute. La.R.S. 40:966(A). The two counts were severed on motion of the defense. In separate trial proceedings, the defendant was found guilty of possession of heroin on the first count and guilty as charged on the second count. He was sentenced to 10 years at hard labor on...
