This antitrust case is presently before the Court on Defendant ACF Industries, Inc.'s ("ACF") Motion for Summary Judgment, filed February 20, 1981. Plaintiff Performance Marketers, Inc. ("PMI") filed a response to the Motion, and oral argument was heard on March 20, 1981. In its Motion, ACF seeks partial summary judgment with respect to the Sherman Act § 1 (15 U.S.C. § 1) claim pled by PMI in Count One...
