This matter is before the court pursuant to motions for summary judgment made by the plaintiffs, Susan and David Daily, and by the defendants, K-Mart Corporation, Butler Improvement Company, and Marlou Realty Company. The occurrence which led to the filing of this suit is basically not in dispute.
