Peck, an inmate at the South Dakota State Penitentiary, filed a pro se, in forma pauperis section 1983 civil rights complaint in the district court alleging that defendant Clifford Hoff, Deputy Warden and member of the South Dakota State Penitentiary Classification Board, violated his rights under the Equal Protection and Due Process Clauses.
