Richard and Ruth Cannon appeal a summary judgment in favor of Seattle-First National Bank establishing liability and awarding damages of $43,000.

Prior to the action for summary judgment, the Cannons were convicted in federal court after a nonjury trial of conspiracy and of aiding and abetting embezzlement of funds from the Seattle-First National Bank. The Cannons' codefendant, Mary Mowery, was convicted of the actual misapplication of the funds...
