When this case was originally before this court (66 A.D.2d 953), we concluded that the trial court erred as a matter of law in denying third-party plaintiff's (Victory) and third-party defendant's (Morgan) motions to set aside the verdict in favor of plaintiff. Having so concluded, we did not consider other allegations of error. Upon appeal to the Court of Appeals, a divided court reversed and remitted the matter to this court for review...
