This is an appeal from the overruling of the appellant's motion for a new trial in a case involving title to real estate.

Appellant brought this action against the defendants alleging that in 1947 J. E. Young, Jr., deeded to the Harry Oesterricher Post No. 5032, Veterans of Foreign Wars, a tract of land located in Brooks County, Georgia, upon which property the VFW constructed a building for the use of the members of the Post;
