Judgment modified, on the law, by deleting therefrom the conviction under the first count of the indictment charging robbery in the second degree under subdivision 1 of section 160.10 of the Penal Law and the sentence imposed thereon, and said count of the indictment is dismissed. As so modified, judgment affirmed.
