Order and judgment reversed insofar as appealed from, on the law, with $50 costs and disbursements, the provisions denying the motion as to Michael Welt are deleted therefrom, summary judgment on the first cause of action is granted as to the lots owned by Michael Welt and the ordinance is declared unconstitutional with respect to those lots.
