Defendant-appellant Garrett was indicted for possession of heroin with intent to distribute, 21 U.S.C. § 841(a)(1), in the Eastern District of Kentucky. Prior to his bench trial, Garrett moved to suppress certain evidence seized after his arrest at the Greater Cincinnati Airport, alleging that his arrest was not based upon probable cause.
