The appellant waived trial by jury on an indictment for theft by taking and was found guilty and sentenced to four years imprisonment. The indictment charges that he "did unlawfully appropriate and take ... [$2,344] in money ... the property of Robert Orlowski, Janice Phillips and Peter Fisher d/b/a Skate Escape, Ltd... with the intention of depriving said owner of said property ..."
