Ronnie Monroe Howie appeals the denial of his habeas corpus petition (No. 3525-II), and his subsequent conviction for perjury and life sentence as a habitual criminal (No. 3870-II). The cases have been consolidated for the purposes of this appeal.

The defendant raises 30 assignments of error in five briefs. With reference to the perjury trial, we need not discuss all of the many assignments since we agree with the
