Charles and Rose Ann Nagy filed a complaint against Robert W. Kelsey and several other defendants alleging a violation of IC 1971, 23-2-1-19(a)(2), Ind. Ann. Stat. § 25-873 (Burns Code Ed.) and common law fraud regarding the sale of certain stock. The trial court granted summary judgment for the defendants other than Kelsey and granted judgment on the evidence against Kelsey.
