CALOGERO, Justice.

Marco Anthony Thucos was charged by bill of indictment with the crime of aggravated rape in violation of R.S. 14:42. A plea of not guilty was entered and defendant was tried by a twelve person jury. A verdict of guilty as charged was returned by ten of the twelve jurors. The trial court thereafter sentenced defendant to life imprisonment at hard labor without benefit of parole, probation or suspension of sentence. We reverse defendant's conviction...
