Billy Wayne Duncan was tried by a jury in Jefferson Circuit Court for violation of § 36-39 of the General Code of the City of Birmingham, 1964, as amended, an offense which is commonly referred to as "interfering with a police officer." The appellant was found guilty and was fined $75.00 and costs. In addition, the trial judge sentenced the appellant to thirty days hard labor for the City of Birmingham.
