DOUGLAS, Judge.

This is an appeal from a conviction for delivery of heroin. After a jury returned a guilty verdict, the court assessed punishment at ten years.

Appellant contends that the court erred in overruling his motion to quash the indictment because it failed to allege an offense. The indictment alleges that appellant "did then and there intentionally and knowingly deliver to Donnie Moore heroin, a controlled substance in Penalty Group...
