T. C. Brennan, Jr., filed suit against James S. Taylor, Jr., and Larry Hausler, trustee, for damages arising incident to the foreclosure of a second lien deed of trust. All parties agree that Hausler was Taylor's trustee and had no personal interest in the case. The trial court dismissed the suit as to Hausler, withdrew the case from the jury and entered a directed verdict against Taylor for $19,976.32 as damages for waste to the security. The court...
