Defendants Joel Garza-Hernandez (hereinafter "Garza") and Ramon Vargus-Villareal (hereinafter "Vargus") were convicted by a jury of conspiring to distribute heroin in violation of 21 U.S.C. § 846 and of possession of heroin with the intent to distribute it in violation of 21 U.S.C. § 841(a)(1). Each defendant was sentenced to ten years imprisonment on each count, the sentences to run concurrently...
