SMITH, Presiding Justice, for the Court:

Chester Lee Cooley was indicted for the murder of Charles Earl Moore. He was tried on that charge in the Circuit Court of Jones County.

Although it appears from the record that the great weight of the overall evidence supported the State's theory that the homicide was murder, the jury returned a verdict finding Cooley guilty of manslaughter, and he was sentenced to serve a term of 17 years in the Department of Corrections...
