OPINION

ONION, Presiding Judge.

Appellant was convicted by a jury for aggravated assault. The jury assessed punishment at imprisonment for 10 years.

On September 20, 1978, we abated the appeal in an unpublished per curiam opinion in order that the record might be approved in accordance with Article 40.09(7), Vernon's Ann.C.C.P., and so that briefs might be filed in the trial court. The record has now been properly approved, and briefs have been filed...
