First Mortgage Investors (FMI) sued to foreclose its mortgage. The defendants were the Fourteen & Twenty-Four Corp. (the mortgagor) and Robert and Betty Yost, guarantors of the underlying promissory note. The trial court ordered foreclosure. That portion of the judgment is not challenged on this appeal.
