OPINION ON REMAND FROM THE SUPREME COURT OF THE UNITED STATES

PER CURIAM.

Robert E. Smith brought this action in the district court against his former employer, the Jos. Schlitz Brewing Co.1 He alleged that his involuntary retirement at age 62 violated the prohibition against age discrimination contained in the Age Discrimination in Employment Act of 1967.
