Plaintiff's petition for worker's compensation benefits was dismissed without prejudice by the referee for no progress. MCL 418.205; MSA 17.237(205), 1972 AACS R 408.40d. Plaintiff had received two extensions of the disposition deadline. The last action in the case had occurred nearly three months prior to dismissal, when the referee denied plaintiff's motion to take plaintiff's testimony by out-of-state deposition.
