DOUGLAS, J.

The defendant, Lawrence W. White, was found guilty of burglary, RSA 635:1, after a jury trial in the Merrimack County Superior Court. Before trial, the Superior Court (Batchelder, J.) denied the defendant's motion to suppress his oral and written confessions. The defendant excepted to the denial of his motion, and the case was reserved and transferred to this court. We remand.

On September 20, 1977, Punky's Mobil Station in Concord was burglarized...
