The United States brought this appeal under 18 U.S.C. § 3731 when the trial court dismissed, after five days of trial, its conspiracy count in an indictment against the defendants-appellees.

The questions on appeal are whether the constitutional guarantee against double jeopardy bars the government's appeal and retrial of defendants on the conspiracy charge, and whether the trial court erred in dismissing the conspiracy count for...
