This is an appeal from a tort action for personal injuries sustained by plaintiff when he was struck in the back by a load of railroad ties being lifted by a crane. Plaintiff sued his employer, New Orleans Public Belt Railroad, Inc., under the Federal Employers' Liability Act (45 U.S.C. § 51 et seq.).
