The defendant was convicted for the first degree murder of James Pickett by shooting him "with a gun". Sentence was fixed at life imprisonment.

The State's evidence revealed that between approximately one and two o'clock on the morning of July 18, 1967, the defendant came to the home of Mr. and Mrs. Willie George Williams exclaiming, "Have mercy", "Come to the door."
