This is an action under the Alabama Surface Mining Reclamation Act of 1975.

The Alabama Surface Mining Reclamation Commission (the Commission) found defendants in violation of the Surface Mining Reclamation Act of 1975 and assessed a penalty of $5,000 for mining coal without a license. The defendants successfully appealed to the Circuit Court of Jefferson County and the Commission in turn appealed the circuit court's decision to this court....
