At the instance of the surety on certain bail bonds, we granted certiorari, 363 So.2d 911, to review certain rulings made by the district court with regard to bail bonds by this defendant.

We consider the primary and dispositive issue before us to be whether, in a criminal prosecution, the trial court may entertain a collateral attack upon the legal qualifications of a surety company which has issued a bail...
