Two cases are consolidated for this appeal.

Initially, plaintiff appeals by leave granted (Docket No. 77-41) from a November 3, 1976, Oakland County Circuit Court order that defendants refer plaintiff's application for a Class C liquor license to the planning commission and police department, and then to reconsider the application. This Court on April 11, 1977, restrained defendants from depleting the remaining quota of available liquor licenses...
